Terms of Service

These Terms of Service describe the rules for using Imagine, Your Personal Display Doctor. Imagine is a mobile application for jewelry retailers, store teams, and display teams to create display projects, answer questionnaires, review display recommendations, save recommendation bundles, and submit purchase requests for follow-up by the Imagine team.

Acceptance of Terms

By creating an account, checking the acceptance box, using the app, submitting questionnaires, saving projects, or submitting a purchase request, you agree to these Terms and to the Privacy Policy. If you use Imagine on behalf of a business, you represent that you have authority to use the app and submit information for that business. If you do not agree, do not use the app.

Your Account

You may need an account to use Imagine. You agree to provide accurate account, profile, store, and contact information, including your email address, name, store name, phone number, and other information requested in the app. You are responsible for keeping your account credentials confidential and for activity under your account. Notify the Imagine team if you believe your account has been used without authorization.

Email Verification and Passwords

Imagine may require email verification before account access. Password reset links and verification codes may be sent to the email address associated with your account. You are responsible for maintaining access to that email account and choosing a secure password.

Questionnaires, Projects, and Recommendations

Imagine uses questionnaire responses, project names, project details, display preferences, selected answer options, and related information to generate display recommendations. Recommendations are provided for planning, comparison, and follow-up purposes. They are not a guarantee that a product, display, fixture, accessory, measurement, inventory configuration, installation plan, price, lead time, or business outcome will meet every need for your store or collection.

Purchase Requests and Estimates

The app may show estimated totals, recommendation bundle items, catalog items, optional accessories, and purchase request details. Submitting a purchase request or inquiry through the app does not create a final purchase contract, does not guarantee product availability, and does not complete payment. There is no final purchase contract until separate purchase terms are confirmed outside the app unless the app later states otherwise. A team member may contact you to confirm details such as product availability, pricing, substitutions, specifications, shipping, taxes, payment terms, installation needs, and next steps.

Acceptable Use

You agree not to misuse Imagine. You may not attempt unauthorized access, interfere with the app or backend systems, submit false or misleading information, impersonate another person or business, upload or transmit harmful code, reverse engineer the app except where allowed by law, or use the app in a way that violates law or infringes the rights of others.

Your Content and Project Data

You remain responsible for information you submit, including profile details, store information, questionnaire responses, project names, purchase request notes, and other content. You grant Imagine permission to use that information to operate the app, authenticate your account, generate and save recommendations, respond to requests, provide support, improve the service, maintain records, and protect the app.

Admin and Support Actions

Authorized Imagine administrators may review and manage user accounts, projects, purchase requests, legal documents, notifications, content, catalog items, and display setup data as needed to operate the service and support users. Admin actions may be recorded in activity logs.

Notifications and Communications

Imagine may provide in-app notifications, push notifications, or email communications about account verification, password reset, projects, purchase requests, support, legal updates, product research, or service messages. Some notification and contact choices may be managed in Settings or Privacy Settings, but operational or security messages may still be sent when necessary.

Privacy

The Privacy Policy explains how Imagine collects, uses, shares, retains, and protects information. By using Imagine, you also agree to the practices described in the Privacy Policy.

Intellectual Property

Imagine, the app design, software, branding, catalog data, recommendation logic, display content, images, and related materials are owned by or licensed to Imagine or its providers. Except for the limited right to use the app as intended, these Terms do not grant you ownership of the app or its content.

Service Changes

Imagine may update, suspend, limit, or discontinue parts of the app as the product evolves. Features, recommendations, catalog items, pricing displays, and workflows may change over time. We may update these Terms by publishing a new version in the app or on this site. Continued use after an update means you accept the updated Terms.

Account Suspension or Deactivation

Imagine may suspend or deactivate access if we believe an account is inactive, compromised, used in violation of these Terms, or otherwise creates risk for the app, users, the Imagine team, or third parties.

Disclaimers

The app is provided on an as-is and as-available basis. To the extent permitted by law, Imagine disclaims warranties that the app will be uninterrupted, error-free, secure, or that recommendations, estimates, catalog information, images, display details, or purchase request workflows will be complete, current, or suitable for every store, product, fixture, collection, or operational requirement.

Limitation of Liability

To the extent permitted by law, Imagine will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost business opportunity, or reliance on recommendations or estimates. Some jurisdictions do not allow certain limitations, so some limits may not apply to you.

Governing Terms

These Terms are intended to apply to the fullest extent permitted by applicable law. If a provision is unenforceable, the remaining provisions remain in effect.
